The Event

This Event is run in partnership with This event is independently organised.. This Event is not affiliated with, endorsed by, or sponsored by HYROX World GmbH or any of its licensees. “HYROX”-style terminology is used only to describe the format of the Event.
These Terms & Conditions (“Terms”) apply to every person who registers for, purchases an entry to, or participates in the Nelson Fitness Race (“the Event”), organised by TBC — registered entity name (“the Organiser”, “we”, “us” or “our”). By registering, you (“the Participant”, “you” or “your”) agree to be bound by these Terms. If you are entering on behalf of another person, you confirm you are authorised to accept these Terms on their behalf and that you will bring them to that person’s attention.
1. Entry & Payment
1.1Places in the Event are limited and are allocated on a first-registered, first-served basis, subject to full payment.
1.2Full payment of the entry fee is required at the time of registration. Your entry is not confirmed and your place is not held until payment has been received in full.
1.3We do not offer instalment payments, payment on account, or entry on the basis of a deposit unless expressly agreed with the Organiser in writing.
1.4Entry fees are stated in New Zealand dollars (NZD) and are inclusive of GST where applicable.
1.5You must provide accurate personal information at registration, including your legal name, date of birth, category/division, and an emergency contact. The Organiser may refuse or cancel an entry made with false or incomplete information.
1.6Race entry, including your race bib and timing tracker, is personal to you and may only be used by the person named on the registration, except where a transfer has been completed in accordance with clause 3.
2. Cancellation & Refunds
2.1Except as set out below, entry fees are non-refundable. This reflects that your entry fee is committed early to venue, timing, safety and equipment costs.
2.2Refunds will only be provided where:
- the Event is cancelled by the Organiser and clause 9 applies; or
- you have purchased optional Participant Cancellation Cover at checkout (see clause 2.4) and your claim is approved by the insurer; or
- a refund is otherwise required by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
2.3Nothing in these Terms is intended to exclude, restrict or modify any right you have under the Consumer Guarantees Act 1993 that cannot lawfully be excluded.
2.5We strongly encourage all Participants to consider their own travel and health/accident insurance for costs not covered by entry fee refund policies, including travel, accommodation and equipment.
2.6A change to your published start time, wave, or heat within the Event schedule is not a cancellation of the Event and does not entitle you to a refund (see clause 5.4).
3. Transferring Your Entry
3.1You may transfer your entry to another eligible person, for a fee of $25, up to 7 days before the Event (“the Transfer Deadline”). After the Transfer Deadline, transfers are closed and no further changes to the name on an entry will be accepted, including on Event day.
3.2To transfer your entry, both you and the incoming Participant must complete the Organiser’s transfer request process (see registration portal) before the Transfer Deadline. The incoming Participant must accept these Terms, provide their own registration details, and meet all eligibility requirements in clause 4.
3.3Transfers between race categories or divisions (e.g. Full to Half distance, Singles to Doubles) may be permitted at the Organiser’s discretion up to the Transfer Deadline, subject to availability and payment of any difference in entry fee. No refund is given where the new category has a lower fee.
3.4Entries may not be transferred, on-sold, or advertised for sale via any third-party platform, including social media or resale sites. An entry obtained through an unauthorised transfer may be cancelled without refund and the holder may be refused entry to the Event.
4. Eligibility, Health & Safety
4.1You confirm that you are physically fit and adequately trained to safely undertake the Event, and that you have no medical condition that would make participation unsafe. If in doubt, you should seek medical advice before entering.
4.2Minimum age for entry is 15. Any Participant under 18 must have a parent or legal guardian complete and countersign the registration, waiver, and emergency contact details before entry is confirmed; entry will not be accepted from a minor without this consent. Participants under 18 remain subject to parental/guardian consent regardless of category.
4.4The Organiser and Event medical staff may, at their sole discretion, withdraw any Participant from the Event at any time on health or safety grounds, including signs of injury, illness, heat stress, exhaustion, or symptoms of a communicable illness. You must comply with any such direction immediately.
4.5You must comply with all instructions from Event staff, marshals, volunteers and medical personnel, and with all published Event rules, station instructions and course markings, at all times.
4.6You participate in the Event, including all functional stations and running legs, entirely at your own risk. This event involves strenuous physical exertion, heavy equipment (sleds, sandbags, kettlebells, ski/row ergometers) and running on varied surfaces, and carry an inherent risk of injury.
4.7Station and course surfaces — Event stations may be run on a range of surfaces including indoor sports flooring, indoor concrete, and outdoor concrete/tarseal or public footpaths, as set out in Event materials. Surfaces are assessed by the Organiser for suitability before the Event; where an assessment leads to a change in the surface used for a station (for example, running a station on concrete rather than a sprung sports floor), the Organiser will notify registered Participants of the change before the Event. Surface conditions may still vary from expectations due to weather, wear, or venue factors on the day, and Participants should wear appropriate footwear and take care regardless of the surface in use.
4.8Attendance at a crowded, physically strenuous event carries an inherent risk of exposure to communicable illness. You accept this risk as part of your participation, in addition to the risk of physical injury described above.
4.9You will be required to sign a separate waiver and acknowledgment of risk as part of registration or at check-in; entry to the Event may be refused if this is not completed.
5. Course, Venue & Weather
5.1Some elements of the Event are held outdoors, including the running course (which uses public streets) and the sled push/pull stations (held on outdoor concrete). Other stations are held indoors. Event materials will set out which elements are indoors and which are outdoors.
5.2Outdoor elements of the Event may be affected by weather, including rain, wind, or heat, even where indoor stations are unaffected. In adverse weather, the Organiser may shorten, reroute, relocate indoors, or temporarily pause an outdoor element of the Event for safety reasons. This is not a cancellation of the Event under clause 9 and does not, by itself, entitle you to a refund.
5.3If a wave, heat, or the Event is interrupted or stopped part-way for safety reasons, the Organiser may void times recorded for the affected wave or heat and may re-run some or all of it on the same day or at a later time, at the Organiser’s discretion.
5.4You will be allocated a start time or wave in advance. The Organiser may adjust published start times or the wave schedule for operational reasons; this does not entitle you to a refund. To record an official time you must start within your allocated wave (or another wave you are reallocated to); the Organiser will close entry to the course at the end of the published wave schedule for the day.
5.5The Organiser is not responsible for incidental costs (travel, accommodation, equipment) arising from changes made under this clause 5.
6. Prohibited Items, Search & Animals
6.1Alcohol, illegal drugs, weapons (including knives), and other dangerous items are prohibited at the venue. The Organiser may refuse entry to, or remove from the venue, anyone found in possession of a prohibited item.
6.2The Organiser may carry out reasonable bag or belongings checks on entry to the venue for safety purposes. Entry may be refused to anyone who does not consent to a check.
6.3Animals are not permitted at the venue, other than a certified guide or assistance dog.
7. Personal Belongings
7.1The Organiser is not responsible for personal belongings brought to the venue, including items left in bag drop or spectator areas. Please keep valuables with a trusted support person where possible.
8. Timing, Bibs & Trackers
8.1Each Participant will be issued an electronic timing tracker at check-in. The tracker must be worn as instructed (typically on the ankle or shoe) for the entire duration of your race.
8.2Timing trackers remain the property of the Organiser or its timing services provider and must be returned at the finish line or at the designated collection point immediately after you finish or withdraw.
8.3A replacement fee of $25 applies to any timing tracker that is not returned, or is returned damaged, lost, or non-functional.
8.4Official results are based on tracker data. The Organiser is not responsible for a Participant’s failure to record an official time caused by a tracker not being worn correctly, and reserves the right to determine results using the best available data, including manual/marshal timing, in the event of a tracker or system fault.
8.5Your name, category, and results (including splits, photos and video footage from the Event) may be published on results platforms, social media and promotional material.
9. Event Changes & Cancellation by the Organiser
9.1The Organiser reserves the right to amend the Event format, schedule, course, station order, or start times, including for reasons of weather, safety, venue availability, or circumstances beyond its reasonable control.
9.2If the Organiser cancels, postpones, or relocates the whole Event due to circumstances beyond its reasonable control (including adverse weather, natural disaster, civil emergency, or venue unavailability), the Organiser will, at its discretion, either:
- offer entries into a rescheduled date or an equivalent future event; or
- provide a partial or full refund, after accounting for costs already committed (e.g. venue, timing, equipment, catering) that cannot be recovered.
9.3The Organiser is not liable for any incidental costs you incur in connection with the Event, including travel, accommodation, flights, or equipment, whether or not the Event proceeds as planned.
10. Liability
10.1To the maximum extent permitted by law, the Organiser, its directors, employees, volunteers, sponsors, contractors and the venue owner are not liable for any injury, loss, or damage arising from your participation in the Event, except to the extent caused by their negligence.
10.2Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993 and the Accident Compensation Act 2001.
10.3Any liability of the Organiser not otherwise lawfully excluded is limited to the amount of the entry fee paid.
11. Code of Conduct & Disqualification
11.1You must treat other Participants, volunteers, staff, spectators and the venue with respect at all times. Abusive, dangerous, or unsportsmanlike conduct may result in disqualification without refund and removal from the venue.
11.2Any form of course-cutting, assistance prohibited by the Event’s competition rules, or interference with another Participant’s race may result in disqualification.
11.3You may also be disqualified, without refund, if you: show visible signs of illness inconsistent with safe participation; are suspected of being under the influence of alcohol or drugs; do not hold a valid entry or bib for the wave you start in; or have provided false identification or age information at registration.
11.4The Event may not be used to advertise, promote, or solicit business for any commercial venture unrelated to the Event without the Organiser’s prior written consent.
12. Catering & Allergens
12.1Where food or drink is provided or sold at the Event, the Organiser and its caterers take reasonable care over allergen labelling but cannot guarantee any item is free of a particular allergen due to shared preparation and storage areas. If you have a food allergy, please check with catering staff before consuming any item provided at the venue.
13. Privacy
13.1Personal information you provide at registration (including emergency contact and medical disclosures) is collected to administer the Event safely and will be handled in accordance with the Privacy Act 2020 and the Organiser’s Privacy Policy.
14. General
14.1These Terms are governed by the laws of New Zealand, and any dispute is subject to the exclusive jurisdiction of the New Zealand courts.
14.2The Organiser may amend these Terms from time to time. The version in force at the time of your registration applies to your entry, except for safety-related rule changes which may be updated closer to Event day and communicated to registered Participants.
14.3If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
